Layered Terms of Service

1. Acceptance

By accessing or purchasing from Layered (https://layerr.co.za), you agree to these Terms of Service. If you do not agree, do not use the website.

2. Eligibility

You must be at least 18 years old or have consent from a parent or legal guardian.

3. Products

Layered sells authentic fragrances sourced from verified suppliers. Product images are illustrative and packaging may vary by batch.

4. Orders

Orders are subject to acceptance, stock availability and successful payment verification. We may refuse or cancel orders affected by fraud, pricing errors or stock discrepancies.

5. Pricing

Prices are displayed in South African Rand and may change without notice. Obvious pricing errors may result in cancellation and a full refund.

6. Payment

Payments are processed through secure payment providers. Ownership transfers once full payment has cleared.

7. Shipping

Delivery estimates are not guarantees. Risk transfers upon delivery to the address supplied by the customer.

8. Returns & Refunds

Returns are governed by our Return & Refund Policy. Return requests must generally be initiated within 3 calendar days. Opened or tested fragrances cannot be returned unless defective or otherwise required by the Consumer Protection Act.

9. CPA Rights

Nothing in these Terms limits rights under the Consumer Protection Act 68 of 2008.

10. POPIA

Personal information is processed in accordance with POPIA and our Privacy Policy.

11. Intellectual Property

All Layered branding, content, logos and website material remain the property of Layered or its licensors.

12. User Conduct

Users may not misuse the website, attempt unauthorized access, scrape data, upload malware or infringe intellectual property.

13. Third-Party Services

The store is powered by Shopify and may integrate third-party services. Layered is responsible for sales made through its store.

14. Disclaimer

Products and services are provided subject to applicable law. Fragrance performance varies based on environment and skin chemistry.

15. Limitation of Liability

To the fullest extent permitted by South African law, Layered is not liable for indirect or consequential losses arising from use of the website or products.

16. Indemnity

You agree to indemnify Layered against claims arising from your breach of these Terms or unlawful use of the Services.

17. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

18. Changes

Layered may amend these Terms by publishing updated versions on the website.

Additional Fragrance-Specific Provisions

Opened fragrances, broken seals, removed cellophane or tested products cannot be returned except where required by law. Layered reserves the right to inspect returned items for authenticity and condition. Fraudulent return requests may be refused.
